Prohibited Uses

Blue Oasis specifically prohibits any use of the Site, and all Users agree not to use the Site, for any of the following:

Posting or transmitting any message, information, data, text, software or images, or other materials ("Content") that may invade another's privacy or publicity rights or is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, hateful, racially, or otherwise objectionable in the sole opinion of Blue Oasis.
  2. Posting, transmitting, distributing, storing, uploading, or destroying material in violation of any applicable local, state, national, or international law or regulation.
  3. Posting, transmitting, distributing, storing, uploading, or destroying material in a manner that will infringe the copyright, trademark, trade secret, patent or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others.
  4. Posting or transmitting any Content that you do not have a right to reproduce, display or transmit under any law or that you are under a contractual agreement to refrain from disclosing.
  5. Impersonating any person or entity or otherwise misrepresenting your affiliation with any person or entity.
  6. Posting or transmitting any incomplete, false, inaccurate or misleading biographical information or information which is not your own. Recruiters, Placement and/or Temporary Agencies representing candidates may not submit a candidate's resume in response to job postings on the Site, without the prior written approval of Blue Oasis.
  7. Responding to any employment opportunity on the Site for any reason other than to apply for the particular job.

In addition, In connection with the Use of the Site, all users agree not to violate or attempt to violate the security or integrity of the Site, including, without limitation:
  1. Use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site.
  2. Take any action that imposes an unreasonable or disproportionately large load on this Site's infrastructure.
  3. Notwithstanding anything to the contrary contained herein, use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents available from this Site.
  4. access data not intended for the User or logging into or otherwise accessing a server or account which the User is not authorized to access;

  6. attempt to interfere with service to any user, host or network, including, without limitation, submitting a virus or corrupted data to the Site, overloading, continuous posting of repetitive text, "flooding", "spamming", "mailbombing" or "crashing";

  8. forge any TCP/IP packet header or any part of the header information in any e-mail or posting.

Violations of system and network security may result in civil or criminal liability.

Ownership and Use of Materials

Blue Oasis grants you a limited, non-exclusive, non-transferable, non-assignable, revocable license to view and temporarily download a copy of the materials displayed on the Site solely for your personal and non-commercial use for yourself or within your organization. All materials displayed or made available on the Site, including, but not limited to, graphics, documents, text, images, sound, video, audio, artwork, software, and HTML code (collectively, the "Material") are exclusive property of Blue Oasis or its content suppliers. The Materials are protected by U.S. and international copyright laws and any other applicable intellectual property rules, regulations, and laws. Resumes

You understand and agree that you are solely responsible for the form, content, and accuracy of any resume or material contained therein submitted, uploaded, or otherwise posted by you on the Site. You further understand and agree that by doing so, your resume may be forwarded, transmitted, or ported to clients and/or third-party business partners of Blue Oasis (which may include recruiters and placement consultants). You understand and agree, that Blue Oasis clients or third-party business partners who received your resume may have retained a copy of your resume in their own files or databases. Blue Oasis is not responsible for the retention, use, or privacy of resumes in such instances.

Termination

Blue Oasis has the right, in its sole discretion, to terminate any services of the Site and remove any Materials from the Site. Blue Oasis shall not be responsible for maintaining or returning your Submitted Materials.

Jurisdiction for any claims arising under Your use of this Site shall lie exclusively with the state or federal courts within San Diego, California.
  3. If any provision of these Terms and Conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
